Trial date set in ANA case

A Nov. 8, 2010, trial date was set to adjudicate claims for fees made by a Denver law firm against the American Numismatic Association.

A Jan. 14 Colorado court ruling provided for “a seven day jury trial.”

Claims by ANA’s former law firm in a since-settled case initiated by former ANA executive director Christopher Cipoletti are that this law firm, Davis Graham & Stubbs, LLP, a Colorado limited liability partnership, should be paid a six-figure fee for work that they were engaged to preform on behalf of Cipoletti and, they claim, the ANA.

This involved suing former ANA employees for defamation, and a bevy of other charges. The claim filed on behalf of the ANA and Cipoletti was against its former computer consultants as well as several former employees in El Paso County, Colorado, district Court, according to documents filed there July 22, 2005.

A news release at the time claimed the underlying suit was brought “to protect the security of its Internet site and the privacy of membership and other confidential information.” It was withdrawn and the issues settled with the former employees three years later.

As a condition of settlement, the ANA agreed to make a payment to offset a portion of the defendants’ litigation costs.

Cipoletti and the ANA were both represented by Janet Savage, a partner in Davis Graham & Stubbs.

Cipoletti was the ANA’s outside general counsel and became executive director on the retirement of Edward C. Rochette in 2003.

After Cipoletti’s discharge in 2007, which the ANA board said was “For cause” –  a curtain of silence descended as the hearing of the controversy began in the murky world of commercial arbitration.

The arbitrator ruled last year in favor of ANA. Cipoletti appealed on grounds that, if proven true, would permit an award to be overturned.

A pretrial conference has been set for Oct. 22 at  9 a.m.
